Terms and Conditions of Sale

These Terms and Conditions apply to all quotations, orders, and sales of products supplied by AQUAPLAT LIMITED trading as Aquaplat (“Aquaplat”).
By placing an order with Aquaplat, the customer agrees to these Terms unless otherwise agreed in writing.
These Terms apply to professional customers, including distributors, veterinary clinics, and other business customers.
1. Quotations and Orders
Product information and quotations provided by Aquaplat are based on information available at the time of quotation.
A quotation does not constitute a binding agreement until the order has been accepted by Aquaplat in writing.
The customer is responsible for ensuring that all order details, technical requirements, and delivery information provided are accurate.
2. Products
Product images, descriptions, and specifications are provided for reference.
Aquaplat may make reasonable updates to product specifications or design due to technical improvements or manufacturing changes, provided that such changes do not materially affect the agreed product performance.
3. Prices and Payment
Prices are confirmed in the quotation issued by Aquaplat.
Unless otherwise agreed, prices exclude shipping costs, import duties, customs charges, taxes, installation costs, and other local charges.
Payment terms will be agreed before order confirmation.
Aquaplat reserves the right to delay shipment if agreed payment obligations are not fulfilled.
4. Delivery
Aquaplat will make reasonable efforts to meet agreed delivery schedules.
Delivery dates are estimates only and may be affected by circumstances outside Aquaplat’s reasonable control, including transportation delays, customs procedures, supplier delays, or force majeure events.
5. Inspection and Claims
Customers should inspect products upon receipt.
Any shortage, visible damage, or delivery issue should be reported to Aquaplat within a reasonable period together with relevant supporting information.
6. Warranty
Warranty coverage is provided according to the warranty terms applicable to each product.
Warranty does not cover damage caused by improper installation, incorrect operation, unauthorised modification, accidents, or normal wear and tear.
7. Returns
Returns require prior written approval from Aquaplat.
Customised products, special orders, used products, or products unsuitable for resale may not be accepted for return.
Return conditions and costs will be agreed before any approved return.
8. Limitation of Liability
Aquaplat shall not be liable for indirect losses, including loss of profit, loss of business opportunity, or consequential damages.
To the extent permitted by applicable law, Aquaplat’s liability shall not exceed the value of the products directly related to the claim.
9. Force Majeure
Aquaplat shall not be responsible for delays or failure to perform obligations caused by events beyond its reasonable control.
10. Governing Law
These Terms shall be governed by the laws of Hong Kong.
Any dispute arising from these Terms shall be subject to the jurisdiction of the courts of Hong Kong unless otherwise agreed in writing.
